Italian legislation provides for a particular type of visa (Golden Visa) reserved for foreign citizens who purchase a residential property in Italy at a price equal to or greater than 500,000 euros and intend to settle in our country and be able to support themselves independently.
The visa (so-called elective residence visa) allows the foreigner to stay in Italy even without exercising any work activity.
The duration of the visa is one year and must be preceded by the issue of a residence permit.
The foreigner must provide documentary proof of having adequate economic resources (e.g. income from commercial activities, annuities, pensions, other income, however different from subordinate work) to be able to reside in Italy, in addition to the availability of a house to be elected to residence.
From the latter point of view, it will be necessary to demonstrate that you have purchased the property in Italy (by producing a copy of the deed of sale) or that you are about to complete the purchase (by presenting, for example, a copy of the preliminary contract, but in this case the visa will be issued only upon presentation of the definitive deed).
In addition to the objective requirements, there is a need, from a subjective point of view, to provide proof of the intention to live permanently in the place elected as residence, that is, to use the property as a habitual residence.
Finally, the foreigner must have an international health insurance (valid in all Schengen countries) with a minimum duration of 30 days and with a minimum coverage of € 30,000 for emergency hospitalization costs and the costs of repatriation.
Currently, to obtain the elective residence visa, the minimum income required is € 31,000 per year for the individual applicant, or triple the annual amount provided for in table A attached to the directive of the Minister of the Interior of 1 March 2000 defining the means of subsistence for the entry and residence of foreigners in the territory of the State.
A similar visa may be issued to the cohabiting spouse, minor children, adult cohabiting and dependent children, and cohabiting parents dependent on the visa holder, only on condition that the aforementioned financial capacities are adequate. Therefore, in the event that the applicant intends to move with the family unit, the amount of monthly income must be increased by 20% for the spouse and by at least 5% for each child, whether the latter is a minor or an adult dependent. .
Since the procedure for obtaining the visa is rather complex, the support of a specialized law firm is considered essential to obtain adequate assistance.
